General Terms and Conditions of Use and Subscription
to the TipStuff Premium service
INTRODUCTION
- TIPSTUFF has developed a solution ("TipStuff") based on a planning and organization application for families, the objective of which is to allow its users to share information between members of the same household in order to collaboratively organize daily tasks.
- The TipStuff application offers its users access to free services and an extended service consisting of additional advanced features, accessible by subscribing to a paid subscription and hereinafter referred to as "TipStuff Premium".
- The purpose of these general terms and conditions of use and sale is to define the contractual and commercial relationships between TIPSTUFF SAS (hereinafter referred to as "TIPSTUFF") on the one hand, and any user who has subscribed to the TipStuff Premium service (hereinafter referred to as "the Subscriber") on the other hand. Their main objectives are to
- Exclusively govern the TipStuff Premium service provided by TIPSTUFF. These conditions apply to the exclusion of all others, including those in effect for other free services offered;
- Describe the conditions under which TIPSTUFF authorizes its customers, natural persons, to use the TipStuff application in hosted mode and all the features offered as part of the TipStuff Premium service.
- The Subscriber acknowledges that he/she will not be able to subscribe to and access the TipStuff Premium service if he/she does not accept these T&C&C without reservation and undertakes to respect them.
1. DESCRIPTION OF THE SERVICE TIPSTUFF PREMIUM
- The TipStuff Premium service is a service offered and operated by TIPSTUFF. Its use is only allowed within the family home circle.
- The TipStuff Premium service is only available to Users attached to a Family account for which a paid subscription has been subscribed, under the conditions mentioned below in the article "Subscription to the TipStuff Premium service".
- In addition to the features of the free TipStuff service, it includes additional services and functions, the main ones being as follows.
- Access to modules exclusively reserved for subscribers such as:
- meal management, allowing you to plan the week's menus, and
- exporting menu ingredients to a TipStuff shopping list.
- Access to an external revenue base.
- Access to additional features to enhance the free modules:
- PDF export of the Agenda view "Our week",
- programming a sequence of several consecutive alarms,
- choice of the start view by the user, etc.
- The description of the functionalities offered by the TipStuff Premium service and the conditions of its use are documented, established and periodically updated by TIPSTUFF, and accessible online.
2. SUBSCRIPTION SUBSCRIPTION SUBSCRIPTION
- To subscribe to the TipStuff Premium service, the User must first be registered as a member of a "TipStuff Family", and have authenticated in the TipStuff application.
- Each User can subscribe to the TipStuff Premium service, which will be valid for all active Users attached to their TipStuff Family account, for a monthly or annual period. You can subscribe to this subscription either via the website or via the TipStuff application.
- The User may choose to subscribe to a tacitly renewable subscription or not.
- To activate the subscription to the TipStuff Premium service, the User must have Internet access, a device compatible with the TipStuff application, and have provided a valid and accepted updated payment method, which can be modified at any time thereafter.
- Following the subscription to the TipStuff Premium service, the Subscriber receives a confirmation email with a link to the applicable TU-CGA.
LIMITED SUBSCRIPTION
- In the event of a subscription of limited duration, the User has the option of renewing the subscription for his TipStuff Family before the expiry of the initial period, or of subscribing to a renewable subscription.
- If the User chooses not to renew his subscription, it automatically terminates at the end of the current period and access to the functionalities of the TipStuff Premium Service is suspended. However, the User can still access the free TipStuff Service.
TACITLY RENEWABLE SUBSCRIPTION
- In the event of a tacitly renewable subscription, the User authorises TipStuff to invoice the subscription fees for the following period via the payment method provided by the User.
- The subscription payment is automatically made to the customer's bank account at the end of the current period, for the coming period.
- At any time, the User has the possibility to cancel the subscription of his TipStuff Family to the TipStuff Premium service, by going to the TipStuff application on his "Family" form and clicking on the link "Stop Premium".
- In this case, the subscription ends at the end of the current period, at the end of which access to the functionalities of the TipStuff Premium service will be suspended. However, the customer can still access the TipStuff service free of charge.
3. FREE TRIALS
- Subscribing to the TipStuff Premium service can start with a free trial. The free trial period lasts 14 days - unless otherwise specified at the time of registration. It is intended to allow the User and other members of his household to check whether the TipStuff Premium service meets their needs.
- Unless otherwise specified, these trial offers will be subject to these terms and conditions of use and subscription, and will be limited to one registration per Family account (same IP (Internet Protocol) address and/or email address) regardless of the trial or discovery offer.
- TIPSTUFF reserves the right, at its sole discretion, to
- determine the eligibility of a Family account for a free trial and limit it to prevent any abuse of the free trial;
- revoke the free trial and suspend a User's Family account if it considers that this Family account is not eligible;
- use information such as device ID, payment method, e-mail address used with an existing or recent TipStuff subscription to determine eligibility. Restrictions may apply to cumulations with other offers.
- The amount corresponding to the chosen subscription will be invoiced at the end of the free trial period via the payment method designated by the user, unless the user terminates his subscription before the end of the free trial period. By providing the banking information in conjunction with the test, the User agrees that the billing will use these payment details.
- Paid subscriptions may not be cancelled before the end of the period for which the User has already paid, and unless otherwise expressly stipulated in these conditions, TipStuff will not refund any fees already paid by the User.
- The subscription formula chosen, the subscription fees, as well as the end date of the free trial period, are information accessible to the User within the "Family" form.
4. NO RIGHT OF WITHDRAWAL
- In accordance with the provisions of Article L. 121-21-8 of the Consumer Code, the User expressly acknowledges and accepts
- that the provision of the TipStuff Premium Service begins immediately after the validation of its registration for the TipStuff Premium Service - i.e. before the end of the fourteen-day period provided for by the Consumer Code;
- not to benefit consequently from the right of withdrawal, linked to online or distance selling.
- Consequently, no request for retraction, cancellation or refund will be admissible for the current period under the subscription subscribed.
5. TERMINATION OF A SUBSCRIPTION
- The User may terminate the subscription of his Family account to the TipStuff Premium Service at any time. He and other active Users of his Family account will continue to have access to the TipStuff Premium service until the end of the billing period - monthly or annual.
- To the fullest extent permitted by applicable law, payments already made are non-refundable and no refunds or credits for periods of partial use will be granted.
- To cancel your subscription
- When the subscription has been subscribed directly from the TipStuff application, the Subscriber must notify it from his account within the TipStuff application, in the "Family" form by clicking on the option "Stop my Premium subscription".
- The termination will be effective at the end of the current subscription period provided that its notification has been sent at least 48 (forty-eight) hours before its end.
- For trial or discovery offers, the termination will be effective until the end date as indicated on the Subscriber's account.
- When the subscription has been subscribed from a third party platform (e. g. iTunes, etc.), the User must first check the conditions for terminating his subscription, and follow the instructions
- The User is informed that the termination procedures (procedure, time limit for taking into account, etc.) may vary from one third party platform to another.
OTHER CASES OF TERMINATION
Deleting the User or Family account
- If the User decides to delete his personal access, or the Family account to which his access is attached while a Subscription is in progress, the Subscription will automatically terminate and access to the features of the TipStuff Premium service will be immediately suspended. In addition, the User will no longer be able to access the Free TipStuff service.
Default in payment - Default
- Without prejudice to any damages that TIPSTUFF may request, TIPSTUFF reserves the right to suspend access to the TipStuff Premium service for all Users of a Family account and/or automatically terminate, without notice or compensation, this Subscription to the TipStuff Premium service in the event of:
- total or partial non-payment of the Subscription price for the TipStuff Premium service by Users of this Family account;
- non-compliance by any of the Users of the Family account with these general conditions of use and subscription,
- circumvention or attempted circumvention by one of the Users of the Family account of the technical protection measures put in place by TIPSTUFF,
- providing false information when registering for the TipStuff Premium Service;
- acts contrary to TIPSTUFF's commercial interests.
7. AVAILABILITY & MODIFICATION OF THE PREMIUM TIPSTUFF SERVICE
- The TipStuff Premium Service is available 24 hours a day, seven days a week, within the limits of the above-mentioned conditions of use.
- However, TIPSTUFF reserves the right to make any changes and improvements to the TipStuff Premium service of its choice as a result of technical developments. TIPSTUFF undertakes that no alteration of quality or substantial modifications of the functionalities of the TipStuff Premium service will result.
- In addition, TIPSTUFF reserves the right to temporarily suspend access to the TipStuff Premium service to ensure maintenance operations related to technological developments or necessary for the continuity of the TipStuff Premium service.
- Temporary service interruptions will, as far as possible, be notified via the Site at least 24 (twenty-four) hours before they occur, except when such interruptions are of an emergency nature.
- TIPSTUFF also reserves the right, without compensation, to terminate the TipStuff Premium service permanently. Any definitive closure of the Service will be notified via the Site at least 1 (one) month before it occurs, the User will no longer be liable for any payment from the date of termination of the Service.
8. PRICE
- The price of the TipStuff Premium Service subscription is indicated in the Premium section of the application - in euros and all taxes included.
- TIPSTUFF reserves the right to change the price of each subscription package. TIPSTUFF will inform Users of each Family Member account of any rate increase at least 15 (fifteen) days before it takes effect, by e-mail to the address provided by such Users at the time of registration (or subsequently modified on their account).
- In such a case, the User who does not accept this rate increase may cancel the subscription for his Family account within the application in the "Our Family" module, as indicated in article 6 above. This termination takes effect on the next monthly subscription term.
- In the absence of termination by the Subscriber, the new rate will therefore be applicable as from the next subscription term following the new rate taking effect.
- Any increase in VAT (Value Added Tax) will be automatically and immediately reflected in the price of the TipStuff Premium service. The same shall apply in the event of the creation of any new tax based on the price of the TipStuff Premium service and for which TIPSTUFF shall become liable. The cancellation conditions provided for in the event of a change in the price of the subscription packages referred to above shall apply under the same conditions in the event of a change in the price resulting from an increase or the creation of new taxes.
- It is recalled that connection and communication (Internet) costs related to the use of the TipStuff Premium service are not covered by TIPSTUFF and remain the responsibility of the User.
9. PRICE PAYMENT
- When the User communicates his bank details to TIPSTUFF, they are not kept by TIPSTUFF.
- Depending on the duration of the subscription chosen by the User, the subscription price is payable monthly or annually. Payment will be made when the subscription to the TipStuff Premium service starts, and then by direct debit on the monthly or annual anniversary date according to the conditions stipulated in the subscription formula chosen, until the subscription is terminated - whether at its own initiative or that of TIPSTUFF.
- In order to optimize transaction security, TIPSTUFF has chosen several payment systems. The guarantees granted by TIPSTUFF with regard to transaction security are identical to those obtained respectively by TIPSTUFF from these payment system vendors.
- Unless otherwise provided by the User, the computerized records, kept in the computer systems of TIPSTUFF and its partners under reasonable security conditions, will be considered as proof of communications, orders, validations and payments made between the User and TIPSTUFF. This information shall be binding between the parties, unless the User provides written proof to the contrary.
10. CONDITIONS OF ACCESS TO THE PREMIUM SERVICE
- The User declares that he/she has the capacity to accept the present general conditions of use and subscription, i.e. to have reached the legal age of majority and not to be subject to a legal protection measure for adults (placing under judicial protection, guardianship or curatorship).
11. RESPONSIBILITY
- TIPSTUFF shall not be held liable in the event of non-performance or improper performance by the User of these GTU-CGA, unforeseeable and insurmountable circumstances of a third party or in the event of force majeure.
- As a simple publisher of the service, TIPSTUFF cannot guarantee the quality of the Internet network or its access and cannot guarantee the absence of interruption of the service specific to the Internet network.
- Consequently, TIPSTUFF cannot under any circumstances be held liable for malfunctions in access to the TipStuff Premium service, for the speeds of opening and consulting the pages of the services, for the temporary or permanent inaccessibility of the TipStuff Premium service, or for the fraudulent use by third parties of the information made available.
- Consequently, it is also the User's responsibility to protect his computer equipment or other equipment, in particular against any form of intrusion and/or contamination by viruses.
- TIPSTUFF shall under no circumstances be held liable:
- an intrusion and/or contamination by viruses of its equipment resulting from a fault, clumsiness or negligence of the User.
- any malfunction or deterioration of the User's equipment resulting from the User's fault, clumsiness or negligence or from an unforeseeable and insurmountable event by a third party.
- if the service offered would be incompatible with certain equipment and/or functionalities of the User's computer equipment.
- the misuse by the User of the TipStuff Premium service, or the use of the User's account by a third party to whom the User has provided his or her identifiers or who has had access to the account as a result of fault, clumsiness or negligence on the part of the User. In these cases, the User undertakes to take personal responsibility for any complaint, claim, or opposition and more generally for any proceedings brought against TIPSTUFF by a third party.
